These Conditions of Sale (hereinafter referred to as “Conditions”) govern the sale of the extra virgin olive oils present on the website www.olioruskia.com (“the Product” or “Products” or “Ruskìa Product” or “Ruskìa Products”) between the end-customer (“the Customer”) and Azienda Agricola Nicola Converso (“the Seller”). Customers are encouraged to read these conditions before submitting any orders of Ruskìa Products. The purchase of Ruskìa Products imply the acceptance by the Customer of these Conditions. If you have any questions about these conditions please send an email to firstname.lastname@example.org before proceeding with the submission of the order. The Customer acknowledges that the exhibition of Ruskìa Products on www.olioruskia.com website constitutes an invitation to offer.

However, unless otherwise agreed with the Seller, Customers are not allowed to purchase Ruskìa Products via the e-commerce service of this website for their subsequent resale. Customers interested in making purchases of Ruskìa Products for commercial purposes (e.g. resale) should separately contact the Seller by writing to firstname.lastname@example.org.
CONCLUSION OF THE CONTRACT
To purchase Ruskìa Products via www.olioruskia.com there are 2 different methods:
- Ruskìa Ecommerce Service
- Ruskìa Non-Ecommerce Service
1. Ruskìa E-Commerce Service
The Ruskìa E-Commerce Service (only available for the following countries: Austria, Belgium, Denmark, Finland, France, Germany, Luxembourg, Netherlands, United Kingdom and Sweden) allows the Customer to automatically submit orders to purchase Ruskìa Products.
Therefore, Clients coming from Austria, Belgium, Denmark, Finland, France, Germany, Luxembourg, Netherlands, United Kingdom and Sweden, can submit their orders of Ruskìa Products by following the procedure described below:
– Select the Ruskìa Product you want (and the desired quantity) and click ‘Add to Cart’ to add the product in your shopping cart.
– Click on “Calculate Shipping”, include your Zip Code and the shipping costs will be automatically calculated.
– Continue by clicking on “Proceed to Checkout”.
– Enter all information required for shipping and click “Continue.” In case of errors, you can correct the data.
– Select your preferred payment method, accept the terms and conditions, and finalize the order by clicking on “Place order”. It is your responsibility to ensure that the order is correct before clicking “Place order”.
The order will be considered as a proposal of the Customer to the Seller to purchase the Ruskìa Product(s). Upon receipt of the order, the Customer will automatically receive a message confirming the order ( “Order Confirmation”). The order confirmation does not constitute acceptance of the proposal of the Customer. All orders are subject to the prior acceptance of the Seller, that (on a case by case basis) will verify the correctness of the information received and its availability to execute the order of the Customer. Therefore, the Seller is not obliged to accept the order of the Customer, and it reserves the right to decline it at its discretion. However, please note that by clicking on the “Place Order” button, the Customer assumes the obligation to pay the price of the Ruskìa Product in the event that his-her order is accepted by the Seller. Any acceptance of the order will be confirmed through a second email ( “Order Acceptance”). At this moment, the Seller is obliged to deliver to the Customer the Ruskìa Product requested in accordance with the provisions of these Conditions. We ask the Customers to check the Order Confirmation e-mail and the Order Acceptance email and to immediately notify us if there are any errors. The Customer acknowledges that the Ruskìa E-Commerce Service may be subject to temporary suspension due to technical or operational maintenance.
2. Ruskìa Non E-Commerce Service
The Ruskìa Non-E-Commerce Service (available for all countries other than those mentioned above – see Ruskìa E-Commerce Service) allows the Customer to purchase Ruskìa Products by filling in a web-form.
Therefore, Clients coming from all countries different than those mentioned above (see Ruskìa E-Commerce Service), can submit their orders of Ruskìa Products by following the procedure described below:
– Send an email to email@example.com or fill out the Ruskìa web-form specifying: 1. type of oil (Donna Felicia, Don Mimì); 2. shipping address; 3. quantities required.
– Customer will receive via email a personalized quote including payment and transport costs.
– If Customer, at his own discretion, decide to accept the quote he/she can proceed to payment through the payment methods indicated in the quote.
– Upon receipt of payment, the Seller will proceed to the shipment of the Ruskìa Product(s) requested to the address indicated by the Customer in the initial order.
Unless otherwise agreed with the Seller, for Customers from countries other than those mentioned above (see Service E-Commerce) the minimum order is of 6 bottles.
PRICES AND BILLING
The prices of Ruskìa Products are displayed in EURO and include VAT and packaging. The delivery costs are always charged to the Customer and are billed at the end of the order as supplement to the selected product.
For purchasing Ruskìa Products via the Ruskìa Ecommerce Service the following payment methods are accepted:
– Credit card or debit card (Visa, Visa Electron, MasterCard or American Express)
– Bank transfer
For purchasing Ruskìa Products via the Ruskìa Non-Ecommerce Service the following payment method is accepted:
– Bank transfer
In case of payment via bank transfer, to speed up the process, we recommend the Customer to write to firstname.lastname@example.org and attach a copy of the document certifying the transfer. Once your transfer is verified, we will proceed to the shipment of the order. In any case, the customer has 7 working days (from the moment of the order) to proceed to the payment via bank transfer. Beyond this time, the order will be canceled. To execute the bank transfer the Customer shall indicate in the reason for payment : (i) the names and / or trade name of the person making the order; (Ii) the number and the date of the order.

It is not possible to guarantee an exact delivery date. In addition, if the Ruskìa Product is delivered outside the European Union, the Customer may be subject to import duties and import taxes, to be paid once the package reaches the specified destination. Any additional cost of customs clearance shall be paid by the Customer. The Seller does not have control over these costs and can not predict their amount.
RIGHT OF WITHDRAWAL
The right of withdrawal is excluded for extra virgin olive oils, being food products that fall into the category of “the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery”, as indicated in Article 16 of the EU Directive 2011/83. The above does not apply in case those products were already damaged or defective at the time of delivery or have been delivered incorrectly. Therefore, for reasons of hygiene and the protection of your health, you can not exercise the right of withdrawal with regard to Ruskìa Products. In any case, we inform the Customer that our trade policy is aimed at meeting their expectations. Therefore, our intention is to always solve, as soon as possible, any issues which will be reported to the e-mail email@example.com.
Legal guarantee for the Customer (consumer)
The customer who is a consumer is entitled to a legal guarantee. To enforce this warranty, the Customer-consumer must notify the Seller any non-conformity found in the purchased products within 2 months from the discovery. In this case, the Customer-consumer will have the right to request the replacement of the product. The Seller is liable for any non conformity of the product which occur within 2 (two) years from the delivery of the Product. Beyond this period, the Seller shall not be liable for any non conformity of the product identified by the Customer-consumer.
Legal guarantee for the Customer (not-consumer)
The customer who is not a consumer is entitled to a legal guarantee. To enforce this warranty, the Customer (not-consumer) must notify the Seller any non-conformity found in the purchased products within 8 days from the discovery. In this case, the Customer (not-consumer) will have the right to request the replacement of the product. The Seller is liable for any non conformity of the product which occur within 1 (one) year from the delivery of the Product. Beyond this period, the Seller shall not be liable for any non conformity of the product identified by the Customer-consumer.
The Seller is not responsible for (i) losses that were not caused by any breach on our part, or (ii) any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure), or (iii) any indirect or consequential losses that were not foreseeable to both the Customer and the Seller when these Conditions were formed. The Seller will not be held responsible for any delay or failure to comply with its obligations under these Conditions if the delay or failure arises from any cause which is beyond its reasonable control.
NOTICE ON THE PRODUCT
Despite all efforts made to represent the Ruskìa Products in the most accurate way possible, some items may appear slightly larger or smaller than their actual size because of screen defects or photographic techniques. Other items may be represented on a larger scale compared to the actual size in order to put in evidence all details, or on a reduced scale in order to show the object in its entirety. In addition, the details shown on the screen (such as colors, designs etc.) may vary based on the device used, and therefore may not accurately reflect the actual properties of the products that will be delivered.
